Escape Game l’Apéro Aix

INTRODUCTION

These Terms and Conditions define the sales agreement between Escape Game l’Apéro Aix and its customers. The products sold by Escape Game l’Apéro Aix are intended exclusively for individuals, companies, communities, businesses, and associations.

By placing an order with us, the customer fully accepts these Terms and Conditions and agrees to waive any conflicting terms of their own.

The website reserves the right to modify these Terms and Conditions at any time. It is the responsibility of the user to review them regularly.

The products and website content are non-contractual. We reserve the right to make any technical or aesthetic modifications deemed necessary, always with the aim of improving our services.


Article 1: QUOTATIONS & PRICING

Quotes provided by phone are estimates only and cannot be considered contractual. Confirmation may be sent by email. Quotes remain valid for one month.

Prices displayed on the website are in euros, all taxes included, applicable on the day of the order (VAT 10%).

The website reserves the right to modify prices at any time. However, once an order has been confirmed, the price cannot be changed.

Prices may be discounted through promotions, coupons, or special offers.

For requests outside these standard conditions, a custom quote may be provided upon request.

The minimum price is based on 3 participants and cannot be reduced further.

Reservations are made for a specific date and time slot and are valid only for that slot. Reservations are subject to cooler availability. A booking is considered final only after the customer receives a confirmation email.


Article 2: AVAILABILITY

Our products, prices, and quantities remain valid as long as they appear on our website and within the limits of available stock.

Orders can only be validated once all required fields have been properly completed.

Placing an order and validating the identification, product selection, and payment steps implies full and unconditional acceptance of these Terms and Conditions. Contractual information will be confirmed by email.

Escape Game l’Apéro Aix cannot be held responsible for food allergies. Customers with allergies must carefully read the labels of the products provided.


Article 4: SECURE PAYMENT

Customers must pay for purchases by bank card or ANCV vouchers at the time of ordering.

Escape Game l’Apéro Aix reserves the right to cancel the entire order process in the event of payment refusal by accredited payment organizations, partial payment, or ongoing disputes.

After the order is placed, additional verification through proof of address and identity documents may be requested to prevent fraud.


Article 5: COLLECTION

Products purchased on the website must be collected at:
Closed Escape Game Aix en Provence
605 Avenue Max Juvénal – 13100 Aix-en-Provence – France.

Collections take place:

  • Between 10:30 AM and 12:00 PM for daytime sessions

  • Between 6:00 PM and 8:00 PM for evening sessions

Traffic delays cannot be considered valid grounds for cancellation.

For Kid’s Party coolers, collection must take place between 10:30 AM and 12:00 PM on the day of the reservation.

The delivery date and time slot are those confirmed at the time of booking.

Escape Game l’Apéro Aix takes great care in preparing the coolers. A verification protocol is carried out before each collection. Coolers are sealed to ensure proper gameplay, making additional verification impossible. Customers therefore accept these delivery conditions.

Food products included in the cooler remain fresh for four hours after collection. Beyond this period, we cannot guarantee product quality and accept no liability.


Article 6: SECURITY DEPOSIT

A €300 security deposit will be required upon collection (by cheque or secure payment link).

Without this deposit, the cooler may not be handed over to the customer, with no refund possible.

Any issue (damaged, broken, missing items, etc.) must be reported upon return of the cooler and may result in partial or full retention of the deposit.


Article 7: CANCELLATION & FORCE MAJEURE

In accordance with Article 121-21-8 of the French Consumer Code, the right of withdrawal does not apply to accommodation services, transportation of goods, car rentals, catering, or leisure activities provided on a specific date or during a specific period.

Therefore, reservations cannot be cancelled or refunded except in the event of cancellation solely by Escape Game l’Apéro Aix. In such cases, the original reservation amount will be refunded to the bank card used for payment.

Obligations under these Terms and Conditions shall be suspended in the event of force majeure, including but not limited to: natural disasters, government actions, embargoes, strikes, exceptional weather conditions preventing delivery, riots, or civil unrest.

The affected party must immediately notify the other party of the beginning and end of such an event; otherwise, liability may not be waived.


Article 8: RETURN OF THE COOLER

To ensure proper return conditions, customers are advised to complete an inventory check to ensure all non-consumable items have been returned to the cooler. A checklist is provided at the end of the game.

Returns must take place:

  • Between 3:00 PM and 5:00 PM on the same day for daytime sessions

  • Before 11:00 AM the following day for evening sessions

For Kid’s Party coolers, return must take place before 9:00 AM the next morning.

Once the cooler has been inspected, an invoice will be sent by email.

Escape Game l’Apéro Aix reminds customers that the cooler must only be used for its intended purpose. If the contents or the cooler itself are damaged, dirty, or incomplete upon return, the deposit may be retained.

If repair or replacement costs exceed the amount of the deposit, the difference will be invoiced to the customer.

All non-consumable items must be returned in perfect condition.

Article 9: RIGHTS

Without prior written authorization from Escape Game l’Apéro Aix, you may not print, copy, reproduce, publish, distribute, transmit, download, store, alter, or modify any content from the website by any means whatsoever.

You may not use the icons or logos to create hyperlinks between websites or use the name Escape Game l’Apéro Aix for any purpose.

Any authorization granted is automatically revoked if any of these conditions are violated.

Unauthorized use of website content may violate copyright laws, trademark laws, privacy rights, advertising regulations, and communication laws.


Article 10: COMPLAINTS

These Terms and Conditions and any related contracts are governed by French law. Any disputes fall under the exclusive jurisdiction of the Court of Aix-en-Provence.

Complaint Procedure

The complaint procedure is free of charge.

Complaints may be submitted:

Admissibility of Complaints

Complaints are accepted within one year from the date of the first payment.

Any compensation request must include proof of payment and reservation confirmation.

Supporting documents proving the claimed damage may also be requested.

Processing Times

A confirmation of receipt will be issued upon submission of a complaint.

Escape Game l’Apéro Aix undertakes to respond:

  • Within 30 calendar days for private customers

  • Within 40 calendar days for professional customers

If necessary, an in-depth investigation may be conducted, suspending the above deadlines.

Appeals

Customers wishing to request a review of their complaint may do so under the same conditions as the initial complaint.

If no satisfactory solution is found, a Tourism Mediator may be contacted. Mediation is free of charge and available to both private and professional customers.


Article 11: PERSONAL DATA & RIGHT TO OBJECT

Information collected by Escape Game l’Apéro Aix is used solely for providing services (quotes, orders, deliveries, invoicing, complaints management, customer relations, satisfaction surveys, etc.).

Only data strictly necessary for these purposes is retained for the required legal duration.

In accordance with French Data Protection Law No. 78-17 of January 6, 1978, as amended, and European Regulation 2016/679 (GDPR), you have the right to access, rectify, restrict, erase, and delete your personal data.

You may also object, for legitimate reasons, to the use of your personal data.
